The European Union is taking a significant step toward a more sustainable and circular automotive sector with the introduction of the new End-of-Life Vehicles (ELV) Regulation which came into force on August 13, 2026. This regulation aims to enhance resource efficiency, increase the recovery and reuse of valuable materials, and improve the environmental performance of vehicles throughout their lifecycle.

The ELV Regulation is designed to strengthen Europe’s industrial resilience by securing a stable supply of secondary raw materials, reducing dependence on imported virgin resources, and fostering a more sustainable automotive industry. By encouraging vehicle designs that facilitate dismantling, reuse, recycling, and recovery, the regulation supports both the automotive and recycling industries in recovering higher-quality components and materials more efficiently.

The Push for Recycled Content in New Vehicles

One of the key aspects of the ELV Regulation is the establishment of mandatory targets for the use of recycled materials in new vehicles. By 2032, new vehicles must contain at least 15% recycled plastic, increasing to 25% by 2036. Additionally, the European Commission will set recycled content targets for steel and aluminium which will apply from 2033.

These targets are crucial for creating a genuine market for secondary raw materials. By providing long-term certainty for investors and manufacturers, the regulation encourages investment in recycling capacity, keeping valuable materials within the European economy. This not only strengthens Europe’s industrial resilience but also reduces dependence on imported virgin raw materials.

Enhancing Collection, Traceability, and Recovery

The ELV Regulation introduces several measures to improve the collection and traceability of end-of-life vehicles. Reinforced traceability requirements, stronger enforcement, and clearer criteria for distinguishing used vehicles from end-of-life vehicles will enhance implementation across Member States.

New measures are also introduced to foster the recovery of critical raw materials, such as aluminium, copper, and rare earth elements, from end-of-life vehicles. These materials will be facilitated for reuse and recycling within the EU. Additionally, the regulation stipulates that from mid-2031, only roadworthy vehicles may be exported outside the EU, helping to protect the environment and prevent the export of end-of-life vehicles as second-hand vehicles.

The regulation strengthens Extended Producer Responsibility (EPR) ensuring that producers contribute to the costs of collecting and treating end-of-life vehicles. This framework creates incentives for more sustainable vehicle design and ensures that high-quality collection, dismantling, and recycling systems are properly financed. It also extends the framework to additional vehicle categories, including lorries, buses, and motorcycles.

The Importance of Secondary Legislation

For the ELV Regulation to succeed, secondary legislation must turn ambitious targets into workable rules. Maria Vera Duran, Policy Director at Recycling Europe, emphasizes the need for fair EPR funding, stronger recycler representation, stable demand for recycled materials, and technology-neutral treatment requirements. These elements are essential to unlock investment while keeping ELV recycling environmentally effective and economically viable.

The regulation introduces new treatment requirements, including a 30% plastic recycling target and quality requirements for aluminium, steel, and shredder residues. Meeting these requirements will necessitate significant investment in advanced sorting technologies and post-shredder treatment (PST) capacity, particularly for small and medium-sized companies.

To enable these investments, it is vital to create stronger demand for recycled materials and ensure well-functioning EPR principles. The uptake of recycled materials in vehicles is a crucial element that will be shaped through secondary legislation. The Joint Research Centre (JRC) is conducting a feasibility study on recycled content requirements for steel and aluminium, aiming to finalize it by the end of the year.

For plastics, although the targets have been defined, it is crucial to establish a methodology for their calculation and verification. This methodology should include independent third-party verification, apply equivalent requirements to plastic sourced from outside the EU, and ensure a level playing field across all recycling technologies.

The ELV Regulation represents a significant opportunity to advance the circularity of the automotive industry. Its success will depend on implementing measures that are both environmentally effective and economically viable. By addressing the remaining imbalances and building on the expertise of the recycling industry, the regulation can contribute to a more resilient, sustainable, and competitive European economy.
